Terms of service

These Terms of Service ("Terms") apply to your use of the Dr.Golf online store and to any purchase you make from it. The store is operated by Dr.Golf ("Dr.Golf", "we", "us"). By using the store or placing an order, you agree to these Terms, our Shipping Policy, our Refund Policy and our Privacy Policy.

1. Who can order

You must be at least the age of majority in your province, state or territory to place an order, or have permission from a parent or guardian. We ship to Canada and the United States only.

2. Our products

Dr.Golf sells golf training aids, including the Tempo Swing Stick, the Connection Band and the Dr.Golf Bundle. We try to describe and photograph every product accurately, but colours can look slightly different on different screens, and some images show the product in use or in a styled setting.

Training aids help you practise; they do not guarantee a particular result, score or distance. Results depend on how, and how often, you practise. Our 30-day swing guarantee (see section 7) is how we stand behind that.

3. Prices, regular prices and offers

All prices are in Canadian dollars (CAD) unless shown otherwise. Applicable taxes and shipping are shown at checkout before you pay.
Where we show a crossed-out regular price, it is the price at which we previously sold that product. The difference shown is your saving against that regular price.
Bundle and limited-time offers apply only while they are shown on the store and may end or change at any time. An offer applies to orders placed while it is live; it can't be applied to past orders or combined with other offers unless we say so.
We may change prices at any time. A price change won't affect an order we've already accepted.
If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after you've received an order confirmation.

4. Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example if a product is unavailable, there is a pricing or description error, or we suspect fraud. If we cancel an order you've paid for, we refund you in full.

The Dr.Golf Bundle contains one Tempo Swing Stick and one Connection Band in the band colour you choose at checkout.

5. Payment

Payments are processed securely through Shopify's checkout and the payment providers shown there. We do not store your full card details. By placing an order, you confirm you're authorised to use the payment method you provide.

6. Shipping and delivery

Shipping rates, processing times and delivery estimates are set out in our Shipping Policy. Delivery times are estimates and are not guaranteed. Risk of loss passes to you when the order is delivered to the address you gave us. Please check your address carefully at checkout.

7. Returns, refunds and the 30-day swing guarantee

You can return items within 30 days of delivery, and our 30-day swing guarantee lets you return a product for a refund of the purchase price if you don't feel your swing has improved. The conditions for both are set out in our Refund Policy. Nothing in these Terms limits any rights you have under consumer protection laws that apply to you.

8. Using training aids safely

Practise only in a clear space with room around and above you, away from people, pets and objects.
Start with slow, controlled swings. Never swing harder than you can control.
Wear the Connection Band snugly but never tightly. Remove it straight away if you feel pinching, tingling or numbness.
Stop if anything hurts, and talk to a health professional if you have an injury or medical condition before starting any new practice routine.
Follow the instructions supplied with your product, inspect it before each use, and stop using it if it's damaged.
Keep products away from young children.

9. Reviews and content you send us

If you submit a review, photo or other content, you confirm it reflects your honest experience and that you have the right to share it. You allow us to display it on the store and in our marketing, and we may shorten it for length without changing its meaning. We may decline or remove content that is offensive, unlawful, misleading or unrelated to our products.

10. Intellectual property

The Dr.Golf name and logo, product photos, videos, copy and the design of this store belong to Dr.Golf or its licensors. You may not copy or reuse them for commercial purposes without our written permission.

11. Links and third-party services

The store may link to or use third-party services (for example payment providers and carriers). Their own terms and privacy policies apply to those services, and we aren't responsible for them.

12. Limitation of liability

Where the law allows, Dr.Golf is not responsible for indirect losses arising from your use of the store, or for injury or damage caused by using a product in a way that doesn't follow section 8 or the supplied instructions. This section does not limit or exclude any liability or warranty that cannot be limited or excluded by law, including your rights and our obligations under the Québec Consumer Protection Act and other consumer protection laws that apply to you.

13. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. If you're a consumer, you also keep any protections given to you by the laws of the place where you live.
